摘要：

宋初“折杖法”的施行 ,使封建五刑中的笞、杖、流刑设而不用 ,只剩下死刑、杖刑 (包括脊杖和臀杖 )和徒刑 ,徒刑的适用面也极窄 ,刑罚体系因此轻重失衡。宋朝政府将前代的配刑加以规范后广泛地适用 ,配刑遂成为宋代最主要的刑种。配刑在起源、性质、内容等方面均不同于流刑 ,也比流刑残酷。但由于配刑弥补了“折杖法”施行后刑罚体系等级结构不合理的缺陷 ,并能满足国家不断增长的工、杂役的需要 ,一定程度上减轻了人民的赋役负担 ,故配刑具有一定的合理性。

  • After the execution of “The Law of Ch aning Into Stick” at the beginning of Song Dynasty, the penalty of cane,stick a nd banihment existed but did not be used.Among the “Five Penalty System”,only the penalty of death ,stick(beat on back and on buttocks) and prisonment remaine d.The penalty of prisonment was used narrowly. The system of penalty of Song Dyn asty lost its balance. The government of Song Dynasty then made the penalty of b anishing as a military servant before more standard,and used it widely,the penal ty then became the main one. The penalty of banishing as a military servant was different from the penalty of banishment in origin,character,content,ect.It was also crueller than the penalty of banishment, but because it could remedy the un reasonable defect of the hierarchy and structure of the penalty system , content the increasing requirement of various services of the country,and, to a certain extent, lighten the taxes and services burden of the people, so it was reasonab le to a certain degree.
