碳排放权交易是当前受到各国关注的环境经济政策之一,全球气候变暖和节能减排客观上促进了碳排放权交易的实践及其立法。我国碳排放权交易制度已经具备法律政策和实践基础,应该选择专门行政法规的模式,从立法上进一步确立企业的碳排放权、主体地位、交易机构法律地位、政府的干预范围、交易程序等内容。

碳排放权交易是当前受到各国关注的环境经济政策之一,全球气候变暖和节能减排客观上促进了碳排放权交易的实践及其立法。我国碳排放权交易制度已经具备法律政策和实践基础,应该选择专门行政法规的模式,从立法上进一步确立企业的碳排放权、主体地位、交易机构法律地位、政府的干预范围、交易程序等内容。

The carbon emission trading is the popular environmental economic policy in most countries nowadays. Global warming and the energy saving mechanism accelerate the legislation and experiment of carbon emission trading. Carbon emission trading has already had the foundations of legislations and certain successful experiences in our country. However, the government should choose the mode of special legislation in order to ensure our enterprises’ carbon trading right, the legal personality of the enterprise and the emission organizations, the supervise range of government and the procedure of emission.
