Based on analysis of the theory and doctrine about legal character of letter of credit, this paper points out that the trade by , using letter of credit is a new and special commercial behavior with special legal character and it is useless to explain the trade by using other theory. In order to solve the legal conflict caused by letter of credit, it is suitable to use the law chosen by the concerned party. If there is no choice or other alternative, the law closely related to country which issues letter of credit should be used.
