“法官释法”:陪审员认定事实的制度保障

摘要：

陪审员参与案件审理最为突出的问题是欠缺法律专业背景,导致实践中出现了"陪而不审"、"审而不议"等现象,严重影响了人民陪审员制度功能的发挥。在新一轮人民陪审员制度改革方案中,陪审员不再审理法律适用问题,只参与审理事实认定问题,但这并不意味着法律的理解与适用对陪审员不再具有意义。恰恰相反,在个案审理中正确认定事实是建立在陪审员能正确理解法律的基础之上的。因而,法官对陪审员进行必要的法律指示是必然的制度选择。法官释法应有必要的限度,以确保陪审员独立、自由判断的审判地位;对法官不当行使释法权之行为,应给予程序关系人必要的救济。

  • Jurors participate in case the most outstanding problem is the lack of legal professional background,thus resulting in the practice "accompany rather try","try rather than discussion"wait for a phenomenon,seriously affect the function of jury system. In the new reform of people's jury system scheme,juror no longer participate in the trial of legal problems,participate in fact only hearing problems. But this does not mean that legal understanding and applicable to the jurors have no meaning. On the contrary,in the case trial for ascertaining the facts right is based on the jurors to the basis of correct understanding of the law. Thus,the judge to jurors necessary legal instruction system is the inevitable choice. The judge interpretation should be the limits of necessity to ensure that jurors independence,free judgment of the trial status. To judge the behavior of the improper exercise of interpretation right,should be given necessary relief to program participant.
