历史法学是西方极为重要的法学流派之一。然而,它在近代中国传播的那段史实,目前学界却没有专门的研究成果。在近代法政书刊中,这一传播过程大体可分为逐步繁盛的三阶段。通过对其文本中数量分布、作者权威、文体类型及载体档次等方面的"指标性"分析和所流布内容在背景渊源、人物谱系、核心命题和方法论上的"知识类别"梳理,以及传播中一种基于评判的"知识再生"的叙说,可多维地呈现出历史法学在中国近代传播的"知识景象",而这正是解析它在中国"学派生长之命运"的底色图景。

  • Historical law is one of the most important in the western law school. However,there is no special research in the propagation of modern China. The process of propagation can be divided into three stages from books of law and political which can be analyzed differently in "standards": quantities,famous authors,literary forms and grades of supporter; in "categories of knowledge": backgrounds,person relationship,core thesis and methodology,and the criticism of"knowledge revive". From the above,it can be analyzed the destiny of Historical School of Law in China.
