权利救济是衡量法治实施体系是否健全的重要标准。构造平等就业权司法救济体系,是贯彻落实依法治国要求加强人权司法保障的重要体现。构造平等就业权司法救济体系,应当发挥立法的统率和引领作用,通过立法全面构建包括建立健全违宪审查制度与宪法诉讼机制、完善劳动争议处理机制、补强三大诉讼机制、发展公益诉讼等司法救济体系;构造平等就业权司法救济体系还应当强化法律责任制度。同时,平等就业权的司法救济并非万能,应当认识司法救济的有限性,避免平等就业权司法救济的"法院中心主义"陷阱。构造平等就业权司法救济体系的总体目标是:平等就业权司法救济应当符合国家治理现代化转型要求,依法构建集党的领导与政策、国家立法、依法行政、公正司法、民众守法等于一体的多元解纷机制,坚持整体和谐主义法治观,坚持对话与合作,综合运用协商、调解等非诉讼程序机制,使司法内部救济与司法外部资源相得益彰,最终形成具有中国特色的平等就业权司法救济体系。

  • Rights relief is an important criterion to measure the law enforcement system is whether perfect or not. Constructing the judicial relief system of equal employment right is an important manifestation to implement the judicial protection system of human rights in accordance with the law. To construct the judicial relief system of equal employment right, we should exert the commanding and leading role of legislation,and establish a comprehensive system of constitutional review and constitutional litigation,improve the labor dispute handling mechanism,strengthen the three litigation mechanisms,develop public affairs litigation and other judicial relief system by legislation; construction of equal employment rights judicial relief system should also strengthen the legal liability system. At the same time,the judicial relief of equal employment rights is not a panacea,we should be aware of the limitations of judicial relief to avoid " court centrism" trap of it. The overall goal of constructing the equal employment right judicial relief system is that the judicial remedy of the equal employment right should conform to the requirements of the modern transformation of the state administration,and construct multiple dispute handling mechanism including the party ' s leadership and policy, the national legislation,the administration according to law,the fair justice,the people 's lawabiding,we should also adhere to the overall concept of harmony and rule of law,adhere to dialogue and cooperation,use consultation、mediation and other nonlitigation procedures to make judicial internal relief and judicial external resources complement each other,and ultimately form equal employment rights judicial relief system with Chinese characteristics.
