摘要：

与中国农村金融"政策推进、行政主导"的改革模式相比,美国《农业信贷法》浓缩了100年来美国人应对"农村金融"这一世界难题的实践理性、法律智慧与立法技术。作为美国农村金融发展的"顶层设计",美国《农业信贷法》以统一立法的联邦法典模式,通过"立法拟制",创设农村金融机构,加强农村金融监管,化解农村金融风险,稳定农村金融市场,保护农民借款人权利,确立以调解为主的农村金融纠纷解决机制,最终将纷繁脆弱的农村金融关系调整成为符合立法目标要求的主体明确、运营高效、市场完备、监管科学、执法有力、司法有效的系统独立的农村金融法律关系体系,堪称"科学立法"的典范。深化我国农村金融体制改革,必须"站在巨人肩上",树立法治意识,完善顶层设计,加快推进农村金融立法,贯彻"目的明确、程序科学","一以贯之、循序渐进","制度协调、形式理性"的科学立法总思路。

  • As "the supreme construction design",the current U. S. Farm Credit Act takes the form of uniform legislation,serving as one part of the U. S. code which orderly integrates all the related rules of farm credit and rural finance. This Act exquisitely constructing a multi-dimensional blueprint for the rural financial legal system in which farm credit banking system centered,supported by the farm credit sustaining system,agricultural borrower protection system,farm credit systematic risk prevention system,farm credit insurance system and farm credit supervisory system. The U. S. Farm Credit Act has provided us great reference significance,which helps and stimulates the active legislation for our rural finance.
