摘要：

有关符合强制性标准与侵权责任承担关系的争议,主要源自对强制性标准的曲解。强制性标准是基本标准、最低标准,不能适应安全价值的需要,也不能实现安全效力的强制。强制性标准仅是侵权责任注意义务的重要产生依据和侵权责任承担的重要判断依据,符合强制性标准不能成为免除侵权责任的抗辩事由。未来实现技术法规与侵权责任承担的关联,需要结合技术法规的法律层级以及具体规范设计分别进行判断。在民法典中,宜以《民法总则》第11条"其他法律对民事关系有特别规定的,依照其规定"作为处理符合强制性标准与侵权责任承担关系问题的法律依据,实现与《标准化法》的相互衔接。

  • The disputes on the relationship between mandatory standards and tort liability mainly originate from the distortion of mandatory standards. It is believed that mandatory standards are basic standards and minimum standards,which do not accommodate to the practical demands or the mandatory achievement of security. Therefore,mandatory standards are merely an important source of duty of care and judgment of tort liability. That means conforming to the mandatory standards shall not be a defense for exempting tort liability. As for the connection between technical regulations and tort liability in the future,we shall judge respectively according to the legal hierarchy and norm design of technical regulations. Then in the Civil Code,we shall deem article 11 of the General Provisions of Civil Law,which is"Where any other law provides otherwise for any civil relations in particular,such special provisions shall prevail",as the legal basis to deal with the relationship between mandatory standards and tort liability in order to connect with the Standardization Law.
