遗传资源知识产权保护经过长久国际谈判效果略微或难成统一,发达国家引导的"生物剽窃"损害遗传资源丰富的发展中国家利益。钭晓东教授的著作《遗传资源知识产权法律问题研究》立足于传统与现代的对话,系统梳理了遗传资源的知识产权法律保护的伦理性内涵及理论契合,补充论证了遗传资源获取和惠益分享机制的伦理性基础,以分配正义、生态正义与整体福利原则以及人权的国际语境为视角,为遗传资源知识产权保护国际话语和制度构建提供不同的理论支撑。

  • Genetic resources intellectual property right protection was debated internationally but there is no consensus result,developed countries make bio-piracy destroy respective rights of developing countries that are rich in Genetic Resources. Mr. Xiao Dong Tou's work on Intellectual Property Rights of Genetic Resources,bases on the dialogue between tradition and modernity,and approximately discusses the ethic connotation and theoretical combination of Genetic Resources Intellectual Property protection. From the perspective of distributive justice,ecological justice and the principle of overall welfare and the international context of human rights,it tries to supplement ethical basis to Genetic Resources acquisition and benefit sharing mechanism,and then provides different theoretical support for the construction of international discourse and system of intellectual property protection of genetic resources.
