摘要：

家庭农场最适应现阶段农业发展的要求,但融资中遭遇金融机构的金融供给不足,最根本原因在于,制度缺乏法律的"顶层设计"。应当确立家庭农场的"融资权",并确认土地经营权的物权法律属性,从而构筑家庭农场融资制度的法理基础。在此基础上,程序上做好确权颁证、经营权评估立法等事宜,实体上构筑"融资权"的救助体系,构建面向"融资权"主体和外部市场的双重法律风险防控制度。

  • Family farm adapts to the modern development of agricultural. But it faces some financing difficulties,such as there are not enough legal systems in banking market.The most reason is that,the"top-level design"of legal is lacking. We should clear"Financing Rights"of the family farm in jurisprudence,confirm the nature of"management Right of land"real right. On the basis,the procedure to do the right certification,management rights evaluation legislation,and construct the relief system of "Financing Rights",regulate dual legal risk prevention and control system for "Financing Rights"body and the external market.
