章太炎的许多同代人都不约而同地信奉进化主义,他们或乐观,或悲观地专事体系,寻找着精神界"支点"。在老派读书人中,只有章太炎一个人觉察到"学问"的不济,并坦率地说出来,承认文章思想学术的"狼狈感",所以他要果敢地革命道德,提倡行动主义的佛家信念,钟情于上古法家立场。本文着重梳理章太炎对公理、进化、代议制、宪政等欧美政治—法律概念的态度,为这位"有学问的革命家"描画出思想姿态,也为他在中国近代法律史中寻找一席之地。

  • Chang Tai-yen plays a very important role in modern Chinese history.Chang's life and thought illustrates the tension between political and legal ideals among the elite of his contemporary.Moreover,his Ufelong commitment to the preservation of the national essence foreshadowed an important trend in the 1910s-1930s,the so-called National Essence Movement.This paper is to evaluate the view of Chang Tai-yen,to explore some representative keywords in his legal thoughts,such as axiom,Darwinism,representative system and constitutionalism.As a " knowledgeable revolutionist",Chang's works are especially unique in Chinese legal culture.
