不在犯罪现场抗辩属于一种"后发制人"式的积极辩护,未经预先告知而在庭审中抛出,将"重创"控方指控。英美国家往往要求辩方在审前程序中以书面方式预先告知控方其意欲在庭审中提出此种抗辩,并开示据以证明该抗辩成立的证人姓名等信息,以消除此种抗辩的"突袭"性。新《刑事诉讼法》引入了不在犯罪现场的术语,而未确立相关的程序规则。借鉴域外成功的立法经验完善我国不在犯罪现场抗辩的程序规则不失为明智之举。

  • Alibi defense is one of "hip-pocket"affirmative defense,which could undermine significantly the prosecution if produced in the trial without advance notice. So the defendant in a criminal action proposes to rely in any way on alibi defense,who shall file and serve on the prosecuting attorney a notice in writing of an intention to claim an alibi,which notice shall contain specific information as particularly as is known to the defendant or the defendant 's attorney,the names and addresses of the witnesses by whom the defendant proposes to establish the alibi. Alibi was introduced into the new criminal procedure code of China in 2012,but there was no rules concerning alibi. It is a wise way to borrow successful legislation in America to prefect alibi rules in criminal procedure code in China.
