"家法族规"独特地体现了中国传统法文化的基本特质,至今仍具潜在和积极的影响。通过外部观察的特征描述,能更好地理解传统的"家法族规"。进而,通过全球化、中外交融、古今融通三种视角,发现传统"家法族规"在法治观念、制度架构、司法技巧三方面的中国现代法治意义。当然,我们也需要警惕其中"封建"留毒的不利影响。

  • The family laws and regulations reflect the basic characteristic of traditional law culture of China specially,which still have positive effects today. The author uses three points of view,which are globalization,communication of China and foreign countries,past and present,to analyze law significance of China on legal senses,construction of system and judicial skills. However,we should pay attention to the disadvantages of feudalism.
