试论改进法科研究生教育研究方法的重要思想理论工具——李双元先生法学思想探微与补遗

摘要：

李双元先生的法学思想最为著名的就是国际私法思想理论,并突出表现在"法律趋同化"理论、"国际社会本位"理念和"国际民商新秩序"的构建理论等方面。正因这些思想理论光环璀璨夺目,可能会使后学产生一种误读:老先生的思想理论限于国际私法领域。为了让更多学人深入了解老先生的其他思想理念,依凭本人对老先生"言传身教、述而不作"的思想理念的记忆,力图整理补遗老先生的思想理念体系,包括治学之道、教育思想、学术思想与法哲学思想等,充实学人的有关认知。故此,不断挖掘老先生的思想理念,尤其是先生现有著述中较少论及而实际教育研究中却有深远影响的思想理念,并充实完善老先生的思想理论体系,对于改进我国法科研究生教育研究方法具有重要理论价值和现实意义。

  • As for colleagues and peers at home and abroad,Mr. Li is very celebrated for his thoughts of private international law,which are theory of law assimilation,ideas of international society centering nature and theory of building the new order of international civil and commercial relations,and what not. And thus people may usually misunderstand his full thoughts,namely,simply focusing on them or even taking it for granted that "thoughts of Mr. Li are only limited to the field of private international law". Therefore,for China's education of scholars of younger age and its reformation,and China's research of international law and its development,it will be greatly valuable both on theory and practice to unscramble his system of thoughts,including methods of studying and researching,ideas of education and thoughts of philosophy of law,etc..
