摘要：

民营企业家涉黑犯罪,既有民营企业生存环境不佳的客观原因,又有企业家刑事法律意识薄弱的主观原因,还与司法机关对打黑政策及涉黑罪名把握不当有关。国家相关部门要严厉打击涉黑犯罪组织渗透经济领域,构建公平竞争的市场秩序,加大对受害企业及企业家的救济力度,为民营企业营造良好的生态环境;国家相关部门要强化企业家恪守刑事法律底线意识,促使企业依法诚信经营,企业自身要加强刑事法律风险防范意识,自觉远离涉黑犯罪;公安司法机关则须准确把握"严打"的打黑政策和"打早打小"的打黑策略,严格界定涉黑犯罪的四个特征,保障未涉黑的企业家应有的合法权益。

  • The underworld crime of private entrepreneurs has following three reasons : the poor survival environment of private enterprises,the weak criminal consciousness of entrepreneurs and the improper perception of the judicial office on underworld crackdown policies and relevant charges. In the economic filed,the relevant departments of the nation must crack down the infiltration of underworld criminal organization,build a market environment of fair competition,strengthen relief force of victim enterprises and entrepreneurs and create a good eco- environment for private enterprises. Government departments must enhance the criminal law- abiding awareness of entrepreneurs,and the enterprises should strengthen their criminal risk prevention consciousness and keep away from underworld crimes consciously. The public security and judicial organs must strictly grasp the crackdown policy,and safeguard legitimate interest of entrepreneurs that do not take part in the underworld crime.
