法治视阈下司法鉴定意见争议问题思考——基于湖南省20起涉鉴上访案例的实证研究

作为司法实践的一部分,鉴定意见的处理需要在法治的视阈下按照法律程序予以解决。涉鉴争议中,维权路径闭塞等因素引起的上访情况较多。湖南省20起涉鉴上访案例反映出涉鉴上访的规律及特点。应当从规范鉴定机构,提升鉴定机构的公信力度,完善相关鉴定程序,破除司法机关对鉴定意见依赖性以及严格落实相关责任追究等方面进行改善。

  • As a part of the judicial practice,the processing of appraisal opinions should be solved by legal procedures under the perspective of rule of law. As for some controversies,many petitions were caused by such factors that the path of rights protection was blocked. Through the analysis of 20 petition cases in Hunan Province,this article,exploring related situations and reasons,put forward four countermeasures including regulating appraisal institutions,promoting public trust in appraisal organizations,perfecting relevant identification procedures,eliminating the dependency of judicial organs on authentication opinions and strictly implementing relevant responsibility investigation.
