摘要：

"平等武装"原则是具有对抗性法律程序中的核心。在医患民事法律关系中,"平等武装"不应仅在医患纠纷出现后的对抗程序阶段。根据对"医闹"演变的分析,认为"平等武装"是患方追求与医方在力量相对平衡的条件下对话与合作的内在需求。故应当接纳患方非理性的愤怒情绪,在医患民事法律关系产生之时为患方提供"平等武装"的机会,以此来实现疏导患方的愤怒,引导患方理性面对医患合作、保证法律适用的公平、提高患方知情同意的决策能力。

  • The principle of "equality of arms"is considered to be the core of adversarial proceedings.In the civil legal relations between the doctors and patients,"equality of arms"should not exist in adversarial proceedings.According to the evolution of"medical disturbers","equality of arms"is considered as the internal requirements of the patients,who desire the equal relationship of dialogue and cooperation with doctors.Therefore,patients' irrational anger should be accepted,and provide the opportunity of"equality of arms"at the time of the civil legal relationship between doctors and patients,which will be able to ease patients' anger,guide patients facing the cooperation between doctors and patients rationally,ensure equitable application of law,as well as improve the decision-making ability of informed consent.
