摘要：

法正当性的中国化建构是解决"社会认同的排斥"和"本土话语的缺失"这两大中国法治建设当下困境的关键。以西方学理,解构西法体系;基于人类规制社会所共同面临的原问题,对照西方,"还原"中国传统。在中西法正当之间,不必强制融通那些指向根本"唯美感性"的传统因素。这些在中国传统法理智慧近代论说中的启示,有利于得出中国法正当性的宏观建构方案。

  • The law legitimacy of China construction is the key,which to solve"exclusion in social identity"and ""deletion in local words"in legal construction 's dilemma recently. Western theories deconstruct the system of western law,based on the common original problem that human regulate the society,to "return"China tradition,contrasting West.There is not have to accommodate factors of tradition which point to the fundament of "aestheticism and sensibility"in the law legitimacy in China and West. It comes to the project of macrography construction of China law legitimacy from the enlightenment of modern theories in jurisprudence wisdom of China tradition.
