《欧洲人权公约》是人类人权发展史上重要的里程碑,是欧洲对《世界人权宣言》贯彻落实的产物。它第一次在国际社会上建立了对人权的共同保障机制,使国家被实质性地限制和约束。而依据该公约建立的欧洲人权法院对于人权与基本自由提供了保障。欧洲人权法院的范式对欧洲国家宪法、基本法、其他公法以及对其他区域性人权公约都产生了深远影响。欧洲人权法院这一人权的区域司法实践为我们提供了思想观念、制度和机制以及个人责任三个层面上的重要启示。

  • European Convention on Human Rights( ECHR) is one momentous milestone in the history of human rights development. The European Court of Human Rights which is founded according to this convention provides security to human rights and fundamental freedoms.First of all,this article focuses on making a thorough inquiry to the founding progress of the European Court of Human Rights. The great damages of two world wars make Europe begin to reflect on itself howto confirm and guard fundamental rights and freedoms of every country,nation and person. Universal Declaration of Human Rights( UDHR) shows the idea and principle of "all are equal",it is clearer and wider in confirmation of rights and freedoms. The founding of European Council clears and definites value norms of democracy,rule of lawand human rights,and it puts human rights as prior. All of these thoughts and patterns setup foundations to European Court of Human Rights to some extent.Second,persons have right to prosecute to nations violates human rights,proceedings and relief programs are improved. If we read and understand the content of ECHR and the specific pattern of European Court of Human Rights,we can find that ECHR clearly expresses main body,nature,exclusion and restriction conditions and corresponding duty of rights in a way of international lawprinciples and regulations. The No. 11 protocol which significantly amended ECHR allows persons can conduct prosecution to European Court of Human Rights,at the same time,the European Court of Human Rights are endowed with compulsory jurisdiction. This changes organization and strengths authorities and obligations of European Court of Human Rights. Every contracting state received more substantial restrictions;every person's right to prosecution are confirmed. Besides,ECHRalso setup special relief procedures that protect procedural rights of person.At last,this article analyzes the influence of European Court of Human Rights and inspires from it. ECHR is the first regional human rights convention which directly docks with and implements UDHR;it is a creative convention which regulates collective actions and supervising,protecting mechanisms.These all deeply influences constitutions,fundamental laws,other public laws of European countries and some other regional human rights conventions.
