民事诉讼属于国家治理的重要一环,在治理中尤其应当注意实质的公平性和适度的介入性。深藏于当事人内心的"公平感"是民事诉讼制度设计和运行的核心。法院对于当事人纷争的适度介入是解决法院既作为服务者,又作为公权力行使者这一角色冲突的良方。实质的公平性和适度的介入性构成一对矛盾,其中实质的公平性是目的,而适度的介入性是手段。手段应当为目的服务,目的也离不开合适的手段。民事诉讼领域治理的特殊之处仅仅在于,目的所追求的是深藏在当事人内心的实质的公平感,而手段所采取的是适度介入的方式。

  • Civil litigation is one of the most important aspects of national governance,therefore great attention shall be particularly attached to the substantial fairness and moderate intervention of state power. The party's sense of "fairness " is the core of civil litigation system in design and operation. By moderately interfering into the parties' dispute,the court may solve the contradiction by offering service,and playing the role that as the public power executor. Substantial fairness and state power 's moderate intervention are a couple of contradictory issues,of which substantial fairness is the purpose,and state power ' moderate intervention is the means. They are complementary. The civil lawsuit field's governance is special in that the purpose is the pursuit of a sense of fairness hidden deep in the heart of parties,and the means are taken by moderately intervention by state power.
