摘要：

宪法宣誓制度是指国家元首以及国家机关工作人员在就职前向宪法宣誓效忠的制度,是政治生活中一项重要的仪式。该制度在2014年党的十八届四中全会上被正式提出,2015年7月1日经全国人大常委会决定被正式确立。同其他仪式一样,宪法宣誓包也含着特定的目的与效力。为了实现我国宪法宣誓制度的效力,避免其仅仅成为一种形式,需要从中国传统文化中去寻找"仪式"产生实效的因素即权力崇拜与实用主义,并运用这些因素对我国宪法宣誓制度的构建和运行提供参考,使其适应中国的法治环境和文化内核,以求真正实现该制度的目的与价值。

  • The constitutional oath system refers to the head of state and the staff of the state organs took the oath of allegiance to the constitution before the inauguration,is a very important ceremony in the political life. The system Have been proposed in the4 th plenary session of 18 th CPC Central Committee in 2014 and have been established in Standing Committee of the National People's Congress' decision on July1,2015. The same as other ceremony,the Constitution oath also contained specific purpose and effectiveness. In order to achieve the effectiveness of the constitutional oath system in China and to avoid it just becomes a form,the effective factors we need to looking for "ceremony " from the Chinese traditional culture are Power worship and Pragmatism,and use these factors to provide the reference for building and running the system of our country 's constitutional oath. To make the system adapted to the China's environment of law and the cultural core,and try to realize the purpose and value of this system.
