摘要：

由于检察机关在审查起诉阶段既具备排除非法证据的客观条件,又不会受到检法关系等制度条件的制约,由其排除非法证据将有助于解决我国现阶段非法证据排除落实困难的问题。检察机关只有在审查证据时贯彻客观中立、无罪推定的原则,并借鉴直接言词原则的合理内核,才能对非法证据进行有效的认定,从而根据违法程度的不同对非法证据进行相应的处理。检察机关在处理非法证据时,要严格把握补正与排除的界限,注重比例性原则的适用,同时借助补充侦查的手段,对一些有挽救余地的非法证据进行补救,平衡惩罚犯罪与保障人权的价值追求。

  • Since the People's Procuratorate has the objective condition to exclude the illegal evidence during the initiation of public prosecution,without the restriction of any institution conditions,besides,it can solve the problem of putting the excluding rules into practice.The People's Procuratorate should keep neutral,observe the principle of presumption of innocence,and take the reasonable contents of direct and word principle,so as to affirm the illegal evidence effectively and handle them accordingly.When the People' s Procuratorate is dealing with the illegal evidence,the boundary between supplementing and excluding is very important.In the meantime,they should pay attention to the proportionality principle.As to certain illegal evidences,supplementary investigation should be applied,so that the worth of punishing crimes and assurance of human rights can be balanced.
