道的价值理念认为,万事万物皆有阴阳两面,如大与小、强与弱、争与让、得与失等,唯有通过节欲自律的"无为",方能消解灵肉之际、人人之际、天人之际的关系冲突,达致阴阳平衡的和谐秩序。受其影响,中华民族养成了谦和不争的民族性格。落实到法律生活中,则体现为人们不愿单纯运用诉讼来解决纠纷,进而逐渐形成"无讼"的法律实践传统,以维系良好的人际氛围,并展现"不争善胜"的人生智慧。在法律万能主义受到挑战的今天,"无讼"的精神价值对构建多元化纠纷解决机制必有所裨益。

  • According to Taoism,Yin and Yang exist everywhere. Big and small,strong and weak,aggressive and concessive,gain and loss. The harmonious order of the balance between Yin and Yang can only be achieved through abstinence and self-discipline to solve the conflicts between materialism and spirit,oneself and others,oneself and the outside world. Under its influence,a modest and concessive national identity is deeply rooted in Chinese character. When it comes to legal disputes,people don't want solve the disputes only by litigation and formed a practical tradition of "non litigation"to maintain good interpersonal relationship and achieve the life wisdom of "victory by concession". The challenge posed upon the omnipotence of law nowadays indicates that the conceptual value of "no using litigation"is benefiting the establishment of a diversified dispute resolution mechanism.
