摘要：

我国现行宪法文本中存在着大量的"依照法律"的表述。通过宪法文本的解释方法,可以确定"依照法律"系指"依照全国人大及其常委会制定的规范性法律文件",从中可以推断出我国宪法的内在逻辑,表明人民代表机关权威最高性和无限性。并由此可以推导出三个结论:人民代表机关无须法律制约;国家机关之间不存在充分的权力制约关系;宪法权利受法律的严格制约。

我国现行宪法文本中存在着大量的"依照法律"的表述。通过宪法文本的解释方法,可以确定"依照法律"系指"依照全国人大及其常委会制定的规范性法律文件",从中可以推断出我国宪法的内在逻辑,表明人民代表机关权威最高性和无限性。并由此可以推导出三个结论:人民代表机关无须法律制约;国家机关之间不存在充分的权力制约关系;宪法权利受法律的严格制约。

dc.description.abstract
According to the analysis of and statistics on the text of the Constitution of the People's Republic of China, this paper holds that there are a large number of expressions of "In Accordance With the Law"(IAWL). IAWL can be defined by a literal interpretation method and other methods of constitution in the constitution text. In essence, the constitutional logic of IAWL is that the authority of the representative organ of the people is the highest and unlimited, and it can make all kinds of laws represent the people as if it likes, and asks for the people and other organs to enforce these laws. Three corollaries can be found through the constitutional logic:(1) the representative organ of the people is in the non-constrained state, and law expansion is irresistible;(2) there are not sufficient restrict of power between national organs; and(3) constitutional rights is in the strict constraints of the law.
