论“八二宪法”30年产权结构的变迁

摘要：

近30年我国宪法中所规定的产权结构发生了重大变迁,主要表现为产权及其实现方式的多元化、非公有制产权所占的份量越来越大。我国产权结构变迁的基本方式是:先有产权及其结构变迁的事实(违宪),然后总结产权变迁的经验并制定宪法修正案(修宪),最后在宪法中加以确认并加以制度上推广(合宪)。这样一条产权结构变迁路线是我国经济体制改革与宪法变迁的必然结果,符合当时社会变革的需求,促成了我国经济发展以及宪法制度的完善,但同时也给我国宪法带来了极大的挑战。对我国现行宪法产权制度进行适当调整,协调宪法内部关于产权制度的各项规定,尽量减少关于产权制度方面的宪法规定,无疑是回应这一挑战的重要思路。

  • The Structure of Property of Rights(SPR)in our Constitution has changed greatly in latest years.The basic way of changes of SPR is that:firstly,there have been the facts of changes of SPR(un- constitutional),secondly,we summed up the experience of SPR and amended the Constitution(constitu- tional amendment),and finally the changes were confirmed in Constitution and extended in law institutions(constitutional).The route of SPR is the inevitable result of China's economic reform,and it was in line with the needs of social change,and contributed to China's economic development,but it also brought great challenges to China's Constitution.The ways of answering those challenges include appropriate ad- justments of SPR,coordination of the provisions of SPR and minimizing the provisions on property rights in the Constitution.
