摘要：

犯罪动机是刑法理论中的一个重要范畴,又一直是心理学的一个重要研究领域。本文在对现代心理学关于动机概念和基本理沦的研究分析的基础上,将心理学中的一般动机概念与刑法学中的犯罪动机概念进行了比较,分析了犯罪动机所独具的特点和功能;并从犯罪动机形成的角度出度,提出了犯罪动机的性质应当具有的刑法评价。同时,对犯罪动机不明显问题的实质进行了考察。综合前述研究,并结合我国刑法的具体规定,本文还进一步探讨了犯罪动机的刑法意义。

  • The criminal motive plays a major role in the theory of criminal law. Meanwhile motive is an important re-search field of psychology. This thesis begins with the analysis of both the motive's conceptionn and the concerned basictheory in the modern psychology. On the basis of this the thesis makes a comparison between the two conceptions: generalmotive in psychology and crminal motive in the science of couniual law. and then illustrates the specific charateristics andfunctions of the criminal motive. From the angle of the criminal motive formation, the thesis advances that the nature ofthe criminal motive should have a value of criminal law. The thesis also studys the nature of the obscure criminal motive.Combining the previous study and the provisons in the Criminal law, the thesis goes further into the signifance of thecriminal motive in the science of criminal law.
