论文从系统功能语言学的情态视角出发,以转写的12场中国法庭审判的真实案例为语料,探讨中国法庭审判中法官的身份构建过程。具体的分析范畴包括情态表达类型、情态主客观取向以及情态量值三个方面。研究表明,法官话语在情态选择上呈现以下特点:一,多选用道义型情态表达;二,多选用客观的情态表达;三,多选用中低量值的情态表达。法官话语中情态表达的选择特点构建了法官客观中立、公平公正的"裁判者"身份。

  • This paper,based on the transcripts of 12 court trials in Chinese local courts,explores the construction of the judges' identity within the framework of modality system of Systemic Functional Grammar.Based on the analyses of modality types,the subjective-objective orientation of modality,and the level of modality,this study investigates the linguistic features of judges' discourse.It finds that judges prefer deontic,objective and medium and low level of modality devices,which constructs themselves as neutral and impartial "referees" in court trials.
